These terms govern your use of mersastudio.com and the purchase of our pieces. Please read them carefully — by visiting our site or placing an order, you agree to them.

In these terms, "Mersa", "we", "us", or "our" refers to the company above. "You" or "your" refers to the person visiting our site or placing an order.

2. Our Pieces

Each item we offer is described and photographed with care. Slight variations in colour, texture, and finish are inherent to the natural materials we use and are not considered defects.

We reserve the right to revise descriptions, prices, and availability without prior notice. Pricing errors will be corrected as soon as they are identified, and we will contact you before processing any order affected.

3. Pricing

All prices are listed in euro (€) and include applicable VAT for orders within the European Union.

4. Orders

By placing an order, you make us an offer to purchase. We accept your offer when we send you an order confirmation by email. Until that point, no contract exists.

We reserve the right to decline or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. In such cases, you will be refunded in full.

5. Payment

Payment is taken at the time of checkout. We accept Shop Pay, PayPal, Google Pay, and all major debit and credit cards. All transactions are processed by trusted third-party providers in a secure, encrypted environment — we do not store your full payment details.

6. Shipping & Delivery

Delivery is made in accordance with our Shipping Policy. Risk passes to you on delivery; ownership passes once payment is received in full.

7. Right of Withdrawal

As an EU consumer, you have the right to withdraw from your purchase within 14 days of delivery without giving reason. We extend this period to 30 days as a courtesy under our Refund Policy.

The right of withdrawal does not apply to:

  • Items made to order or personalised
  • Sealed intimates, bodywear, or pierced jewellery once unsealed
  • Items marked Final Sale at the time of purchase

Faulty, Damaged or Incorrect Items

If your order arrives damaged, faulty or incorrect, please contact us within 48 hours of delivery at hello@mersastudio.com.

Please include your order number and clear photos of the issue. If the item is confirmed to be faulty, damaged or incorrect, we will arrange a suitable solution, such as a replacement or full refund, including applicable shipping costs.

9. Intellectual Property

All content on mersastudio.com — including imagery, text, design, logos, and the Mersa name — is the property of Mersa and protected by copyright and trademark law.

You may not copy, reproduce, or use our content for commercial purposes without our written consent.

10. Acceptable Use

When using our site, you agree not to:

  • Use it for any unlawful purpose
  • Interfere with its security or operation
  • Attempt to access accounts or data that are not yours
  • Use bots, scrapers, or automated systems without permission
  • Resell our pieces commercially without authorisation

11. Liability

To the fullest extent permitted by law, our liability is limited to the price of the pieces you have purchased. Nothing in these terms limits or excludes our liability for death, personal injury, or any other liability that cannot be excluded under Dutch law.

12. Privacy

We process your personal data in accordance with our Privacy Policy and the GDPR.

13. Changes

We may update these terms from time to time. The current version will always be published on this page, with the date of the last revision shown above. Continued use of our site after changes constitutes acceptance of the revised terms.

14. Governing Law

These terms are governed by the laws of The Netherlands. Any dispute will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
